Craptic Enterprises and/or its subsidiaries, affiliates, and associates (hereinafter referred to as “Dreamstrikers” or "We" or "Us" or "Our") provide products and/or services through the website/app, which is subject to the following terms and conditions (hereinafter referred to as "Terms", as well as the refund policy, etc. We strongly encourage all users to read our terms before using our services. Each user is bound by the terms, which can be accessed only when they comply with them at all times. All updated, modified, or the users must fully understand published terms. We will not be affected by the invalidity or unlawfulness of our terms if one or more judicial or quasi-judicial bodies in India determine that one or more are invalid or unlawful for any reason. We will still be able to enforce our remaining terms on all users, so this will not affect the validity of our remaining terms.

Anyone who does not accept our terms of service can or should stop using our website/app. Our clear and unambiguous intention is that users will grant unconditional, permanent and absolute consent to Dreamstrikers for the collection and use of information by the Website/App and its partners and affiliates as set forth in our Privacy Policy. A User has granted this permission to Dreamstrikers in writing by using the Website/App and its Services, and Dreamstrikers/Website/app must take no further action to obtain this permission from Users.

The Website/app and Terms may be modified at any time by us without prior permission.

The validity or enforceability of the terms will not be affected if any of the Terms are determined to be unlawful, invalid, void, or unenforceable for any reason whatsoever by any judicial or quasi-judicial body in India. You shall not be deemed to have waived Our right to act regarding any breach of the Terms by You by our failure or delay to act or exercise any such right or remedy.

Any User who breaches, reasonably believes that such User has breached, or illegally or improperly accesses, uses or accesses the Platform or participates in the Contest may, in its sole and absolute discretion, restrict, suspend or terminate the User's access to the Platform or Contests without notification to the User, delete or deactivate the User's Account and all associated information on it, delete any content posted by the User on the Platform, bar users from participating in contests, and take any other legal and technical steps necessary.

The Company will not be responsible for refunding any Platform Fee already paid for any Contest if the User breaches or violates these Terms. In addition, any wins (as defined herein) due to such Users and any win amounts credited to such Users will be automatically forfeited. Users may apply the balance to their accounts, excluding any accumulated wins, against losses and damages incurred or assessed by Us in case of a breach or violation of these Terms. Any remaining amount (if any) shall be returned to the User.

Applicability

You are responsible for carefully reading and reviewing the terms provided on the Dreamstrikers site before registering. These terms apply to all services offered on the Website/app and product-specific conditions and rules applicable to specific products offered on the website/app. Fantasy cricket is one such product.

User Representations

You should provide accurate and complete information to us at the registration time or any subsequent time.

The Participant further represents that they do not suffer from any physical or mental condition that may affect their performance. Additionally, acknowledge that they are solely responsible for any consequences resulting from your participation in this Activity or being associated with it. Dreamstrikers does not assume responsibility for any financial loss incurred due to their participation in the Activity.

As a participant in a Game on the Website or app, you accept that there is no obligation on our part to give you a win. As a player, you will win entirely based on your skill in relation to other players in the Game and your adherence to the Game's rules. You may incur financial losses if you participate in any of our games ("Activity").

By using the Website/app, you acknowledge and agree that you are solely responsible for posting, transmitting, uploading, or making any available content. You are responsible for legal ownership or licensing of all content you post. Any content you publish on our Website or app will be used, copied, reproduced, modified, adapted, published, edited, translated, derivative works created from, transmitted, distributed, publicly displayed, and publicly performed by us or our affiliates without charge. Our affiliates may use such content in marketing materials related to the Website/app. This content may include, without limitation, your name, username, location, messages, gender, or pictures. Understandably, funds held in your user account by Dreamstrikers don't earn interest.

Dreamstrikers will not be held responsible if you cannot participate in any Game for which you may be eligible. You may also experience difficulties logging into your account if your account is pending validation or if you have been suspected or established to be violating the Terms of Service.

As a user, you understand that by viewing or using the Website/app, by availing of any Services or using communication features on the Website/app, you may be exposed to offensive, objectionable, or indecent content posted by other users. If you find offensive, objectionable, or indecent content posted by other users, you may bring it to our attention, and we reserve the right to take appropriate action. You are bound by the decision we make in this regard.

User Restrictions:

Anti-Cheating and Anti-Collusion:

You represent that you intend to play all Games you have registered/joined and will not use any form of external assistance to play any of them. Attempts to enlist such external assistance are strictly forbidden. Multiple IDs:

We strictly prohibit any form of fraud, including adding cash to your user account with another person's credit card(s), debit card(s), net-banking username, password, authorization code, prepaid cash card, or mobile phone.

A user account belonging to another person cannot be accessed or attempted to be accessed through the Services.

Each player's winnings are unique and cannot be transferred. Any winnings that are attempted to be transferred will be forfeited.

In the case that you are an officer, director, employee, consultant, or agent of Dreamstrikers or a relative of such person ("Associated Person"), you are not permitted to participate in any Games that are intended to give you a chance to win any prize on the Website/app, other than in the course of your engagement with Dreamstrikers. In this context, relatives include spouses, parents, and financially dependent children.

Transactions & Payments

Upon registering on our Website/app, we keep a record of all your transactions with us in your user account. You must log in to your Dreamstrikers account to make payments associated with Cash Games. You will receive credit for all cash you win in this user account.

To Add cash to your user account, you must use an instrument you own to make a payment. For purposes of participating in Cash Games on the Website/app, you may deposit as much money as you want in your user account, subject to the Add Cash limits specified by us from time to time.

Dreamstrikers encourages you to use the Website/app responsibly. Users can add cash to their user accounts subject to monthly cash limits, undertakings, indemnities, waivers and verification conditions as we deem appropriate.

Payments are processed through third-party payment gateways, including credit cards, debit cards, and prepaid cash cards. Other payment methods require authorization from the intermediary that processes the payment. Payments will be processed solely according to their policies and procedures without any responsibility or risk on our part. We are not responsible for delays or denials at their end. In the "Complaints and disputes" section below, we provide a procedure for filing complaints if there are any issues with adding cash. Unless in any way, we are not responsible if we delay or eventually decline your credit for reasons beyond our control. After payment or transaction is authorized, the funds will be credited to your user account so that you can play Cash Games.

Dreamstrikers is not responsible for any internet connectivity issues, disruptions due to the configuration of your local internet environment, or software or hardware configuration on your end. Voluntary Account Termination and Suspension:

You must follow all rules and regulations of the Games. You must ensure that you read and understand all the rules and regulations. Additional Games may be added to the Services from time to time. This Agreement will govern all Game Rules relating to such Games. Whenever we introduce new Games to our Website, we will let you know about them and let you read the Game Rules. Each Game's results and winners will be determined according to the Game Rules. As a participant in any game or tournament, you agree to these determinations and shall not challenge them. Limitation of liability and indemnity

As a condition of using the Services, the Site, or the Software, you agree to indemnify and hold harmless Dreamstrikers from any claims, actions, suits, damages, penalties, or awards brought against us on account of your use of those services, the site, or the software.

The Dreamstrikers expressly disclaims all liability and responsibility for any harm resulting from your participation in, or cancellation of, any game, any activities or transactions you have carried out with third parties through the Services, the Website, or the Software, or any User-generated Content, including any violation of intellectual property rights.

Intellectual Property

Regarding the Services, the Site, and the platform, as well as any content or information displayed or contained therein, all tangible and intangible rights, including copyright and other intellectual property rights, are exclusive to Dreamstrikers unless expressly stated otherwise. A user can play games online at Dreamstrikers only for personal use, and no other commercial advantage is passed on to the user as a result of the user playing the game.

You don't own any intellectual property rights in the Services, Site, or Software you access through the platform or any other property you access through the Services, Site, or Software. Users can contribute or create content on Dreamstrikers, including chat messages and message boards/forums. You acknowledge that Dreamstrikers is not liable for such contributions. The permission to access such User-generated Content is granted at your own risk, and Dreamstrikers will not be liable for any obscene, defamatory, illegal, or otherwise offensive User-generated Content you may encounter.

No failure of either party to insist on strict performance of any of the terms or provisions contained herein or exercise of any option, right, or remedy contained herein shall in the future be construed as a waiver or relinquishment of those terms, provisions, options, rights, or remedies, but such terms, provisions, options, rights, and remedies shall continue to apply and remain in force. There will be no waiver of any of these terms or provisions by either party unless it is in writing and signed by the other party.
